Car, Bike, Motorcycle, Pedestrian, Trucking and Motor Vehicle Crashes Our Law Firm Has Handled Mostly in Vermont in Recent Years

  1. Intersection Crash at VT Route 15 and Needle Eye Road in Morristown, Vermont – At the time of the crash, the weather was clear and the road surface was dry. Our client had stopped his vehicle in the westbound lane of Route 15, waiting for eastbound traffic to clear so he could turn left in a southerly direction onto Needle Eye Road. While he was waiting for oncoming traffic to clear, he was struck from the rear by the negligent driver. The negligent driver claimed that the sun was setting at the time of the crash, causing a significant glare. She claimed she could not see our client’s vehicle at all and that is why she smashed into it without braking. The investigating police officer determined that the crash was caused solely by the negligent driver failing to property scan the roadway in front of her while she was traveling on Route 15. Therefore ,claiming that being blinded by the sun is not an excuse if you cause a crash.

  1. Flying Box Crash at Willow’s Crossing in Johnson, Vermont – Our client was a motorcyclist who was operating his motorcycle at or near the speed limit of 50 miles per hour. He could not recall any of the facts that caused him to crash. It turns out that the truck in front of him was transporting a cardboard box in the back of the truck which was not secured. The driver of the truck said the box flew out of the truck and hit our client, causing him to lose control of his motorcycle. He suffered serious injuries as a result of the crash. The investigating officer determined that the driver of the truck was solely at fault for the collision. The officer was able to locate the cardboard box in question, which was located nearby the crash scene on the side of the roadway. The operator of the vehicle was given a ticket for failing to secure a load in his vehicle, causing a collision.

  1. This crash occurred in Morristown on VT Route 15, not far from Lamoille Valley Chevrolet (formerly known as McMahon’s Chevrolet) now located in Hyde Park. Our client was proceeding in a westerly direction on Route 15 and had stopped to make a left-hand turn into a driveway on the south side of Route 15. Our client had her directional signal on for a left-hand turn. The driver in back of her was not paying attention and smashed into the rear of our client’s vehicle. He claimed he was distracted by a vehicle that was parked on the side of the road and he did not have enough time to stop when he saw the vehicle in front of him stopped.

  1. Our client was approximately a half mile from his home while he was driving along North Road in Eden. A car coming from the opposite direction crossed into our client’s lane of travel, smashing directly into the front of his vehicle. The other driver apologized and gave no excuse as to why he had crossed into the wrong lane. This was another clear liability case.

  1. Our client was making a left-hand turn onto VT Route 15 at the intersection with Center Road in Morristown. The wrongdoing driver was operating at a high rate of speed with his lights off. He smashed in the side of our client’s truck. The police officer found that the negligent driver was completely at fault.

  1. This crash was another one that occurred not far from Willow’s Crossing on VT Route 15 in Johnson. Our client was traveling eastbound on Route 15. He noticed a vehicle in the westbound land with its left turn signal on. He then saw a truck going excessively fast. The truck smashed into the rear of the vehicle that was stopped waiting to make a left-hand turn. The vehicle then came into our client’s lane of traffic, colliding with his vehicle. The investigating officer determined that the negligent driver was inattentive and driving too fast and was issued a number of citations.

  1. Motor Vehicle Collision on VT Route 15 Near Mac’s Market in Morristown – While proceeding in a westerly direction, three vehicles in front of our client’s vehicle stopped to allow a car to turn into Mac’s Market. 1. Pedestrian Injury in Stowe, Vermont – Our client was out for her afternoon walk on a class 3 road. There are no sidewalks at the location where impact occurred. The investigating police officer determined that our client had the legal right to walk in the road, as she was as far over to the side of the road as she could have been. 1. Motor Vehicle Collision on VT Route 15 in Wolcott, Vermont – Our client had stopped his pickup truck while traveling in a westerly direction on Route 15 with his turn signal on intending to turn into a driveway. The vehicle behind our client was distracted by a pickup truck off the road and did not realize that a vehicle had stopped in front of him. He smashed into the rear of our client’s vehicle, causing serious injuries. The investigating officer determined that the negligent driver’s attention was distracted when he was looking at a vehicle off the road and this was obviously the sole cause of the crash.

  1. Intersection Collision at VT Route 100 (Truck Bypass) and Bridge Street in Morrisville, Vermont – Our client was proceeding in a northerly direction on Route 100 approaching Bridge Street. The negligent driver ran a red light and smashed into the side of our client’s vehicle, causing injuries to our client and his passenger. The investigating officer from the Morristown Police Department determined that the negligent driver was the sole cause of the crash.

  1. Rear-end Collision Occurring on VT Route 100 in Waterbury at the Intersection With the Entrance to Ben & Jerry’s – Our client was operating his vehicle in a southerly direction on Route 100. He was on his way to Burlington with his young son as a passenger. There were two cars in front of our client’s vehicle that had stopped to allow a recreational vehicle coming out of the Ben & Jerry’s entrance to make a left-hand turn onto Route 100 North. Our client’s vehicle was rear-ended by a car that was going extremely fast. The impact was great enough to total our client’s vehicle. The investigating officer determined that the other driver was obviously completely at fault.

  1. Single Vehicle Crash on Ober Hill Road in Johnson – Our client was a passenger in a vehicle operated by a friend. The driver dropped her cell phone and looked down to find it. She lost control of the vehicle and it went off the road and hit a tree. The impact of the crash was significant enough to cause serious injuries to our client.

  1. Single Vehicle Crash on Plot Road in Johnson – Our client was a passenger riding shotgun in a motor vehicle operated by a friend. The driver took a turn too wide at an excessive rate of speed, struck a mailbox and then careened back across the road. The driver was found to be operating his truck at an excessive rate of speed and was charged with careless and negligent driving.

  1. Intersection Collision at VT Route 100 (Truck Bypass) and Bridge Street in Morrisville – Here is another crash that occurred at the relatively new intersection of Bridge Street and Route 100, also known as the truck bypass. There is a traffic signal at this intersection. Our client was traveling south on Route 100 at the speed limit of 40 miles per hour. The other driver was proceeding in a westerly direction on Bridge Street. He claimed to be driving approximately 35 miles per hour at the time of the crash. The posted speed limit on Bridge Street is 25 miles per hour. He ran through a red light, crashing into the side of our client’s truck. The other driver was issued a ticket for running a red light.

  1. Rear-end Collision on VT Route 15 in Wolcott – Our client was proceeding in a westerly direction. She stopped her car to let a deer cross the road in front of her when she was rear-ended by another driver. The investigating officer determined that the other driver was completely at fault for failing to pay attention to vehicles in front of her.

  1. “Sandwich” Collision on US Route 7 (Shelburne Road) in Shelburne, Vermont – Our client was traveling south approaching the Martindale Road intersection when the vehicle in front of him quickly stopped in the middle of the intersection. The driver that stopped abruptly did not have his left-hand turn signal on. Our client was able to stop in time, but was hit from behind by a tractor trailer truck, which pushed him into the vehicle in front of him. The tractor trailer driver was following our client’s vehicle too closely to stop his truck in time before striking our client’s car. The investigating state trooper attributed negligence to both the driver of the vehicle in front of our client’s car and the tractor trailer driver that smashed into the rear of his car. The trooper determined that the driver in front did not signal to turn left and that he stopped in the middle of the intersection where stopping is prohibited. The trooper also determined that the tractor trailer driver was following too closely to react in time and stop his rig. Both negligent drivers blamed the other and we were forced to file suit against both of them. Ultimately, the case settled at a mediation conference with the tractor trailer driver’s insurance company paying 65% of our client’s damages and the insurance carrier for the vehicle in front paying 35%.
