Can You Recover Money in Vermont When You Fall Through a Grate on a Deck in Vermont? The answer is yes. This is a form of a negligence claim know as a premises liability claim.

A client of mine fell through a grate while working at the site of the insured property owner and we were able to recover money from the owner’s insurance company for the owner’s negligence.

Under Vermont law, property owners have a duty to maintain their premises in a reasonably safe condition so that guests, invitees and employees of companies hired by the property owners would not be at risk of harm when they visited the premises.

A grate is a part of a deck that is something a person would anticipate as being safe and a surface that they could walk across. However, if a grate is not properly maintained and is unsafe for visitors the owner is responsible for the injured person’s damages. Owners should have expected that a person was going to walk over the grate and therefore it should have been inspected to make sure it was safe.
