Can I Still Receive Money in a Car Accident if Both Drivers Are at Fault?

by | Sep 22, 2020 | Firm News

There are some auto accidents where both drivers are partially at fault. In Vermont you can still receive money if you are no more than 50% at fault. If you are 51% at fault you will recover nothing. Your damages are reduced by the amount of your comparative negligence.

For example if your claim is worth $10,000 you would recover $5,000 if you were 50% at fault. In the case noted below it appears that both drivers were partially at fault so they might be able to recover half of their damages from each other’s insurance company.
